Relationships are always complicated, but they become even more so when there are children involved. It is not uncommon in the modern age for couples to split up after they have had one or more children together. Quite often when this is the case, the splitting of the couple is not overly pleasant and there can often be ill feeling between the two, especially from the mother’s point of view. If you find yourself in this position as a mother you may well want to try and remove the father's name from the child’s birth certificate. Unfortunately, this is not really something that can be done legally. No matter what your relationship is with the father of your child, there is no way to have his name completely removed from the birth certificate, at the end of the day even if you really dislike the father and he is not present in the life of your child he is still legally the father and therefore his name must remain on the birth certificate. The only legal way that you can have the father's name removed from the birth certificate is if you can prove that he is not actually the natural father. This can only really be done by taking a DNA test of the father’s blood and showing that he is not the biological father. You should also consider that as your child gets older they may well not be pleased with you if you have had their father's name removed from the birth certificate purely because of your feeling towards him.
The birth certificate is a legal document. You would need a lawyer to help you through this. You would need the mothers signature, the fathers whose name is on the cert and the father whose name wants to be on there. Then you need a judge to say it's OK to do that.
Did the father whose name is on the B/C now adopt the child? That would make him the legal father and more difficult to change the name.
Why is it so important to change the name? In the end after all is said and done, nothing will be different except the knowledge of the name change. There may also be a whole lot of hurt feelings and strained relationships after all is done. This could go on for years, are you truly ready for this battle?
Good luck to you.

I have found out that the father on the birth certificate is not the biological father but I thought he was at the time of the birth
I find the "top answer" a little patronising. Not all mothers that want to remove a fathers parental rights wish to do so due to their own selfish feelings. Sometimes there is an aspect of their childrens safety to consider; I am also sure the majority of mothers looking into it have no light hearted intentions. It is never nice to feel judged. People should have a little more empathy because situations are not always predictable. You can never change time.
I recently found out my babies dad isn't the guy I thought it was for a year. How do I get him off it?
My son's mother had another man sign his birth certificate. I have been in his life since day one, he is now 8. She is becoming a very unfit mother and I would like to have custody of him. The guy who signed the certificate is not willing to take a paternity test, to allow me to prove that I am the father. What can I do to get his name off and mine put on, so I can ask for custody? I love in clearfield county in P.A.
You would need to file for a legal name change with the court. And it is possible that the court would deny the name change depending on where you live. The only way to remove his name from the birth certificate is if someone else legally adopts your son. Regardless of whether he is around or not, he is still legally the father.
When my oldest daughter was younger and I divorced her father he disappeared. When I enrolled her in school, I just enrolled her with my last name and no one ever argued with me. I just told them that was the name she used and that she didn't know her father or anyone with her legal last name. Later on we did go to court and legally change it so she could have her SSN changed and get a drivers license with that name on it.

Yes you can have a paternity test done to confirm he is not the father
Oh absolutely , and they may require a DNA , so without a doubt he isn't the father .
How do I even explain this. My sons dad died and I was with a man that signed a paternity affidavit for my son and switched his name to his last name... Now I need to get him off bc he don't want to be on there anymore because he became abusive and I left him. So what do I do.? He signed the affidavit knowing there was no possible way he was the father
I'm sorry to here that but I'm sure you can.
You can do a paternity by your self just get one at Rid Aid.
You can get a DNA test at Rid Aid.
I want to know what to do to remove the farther of my child name off the birth certificate
Absolutely you can and they may require a DNA, to make sure you are not in fact the father , but yes you can take your name off for a fee in some states
Can I remove my name from the birth certificate I am not the childs father. Do I still have to pay maintenance if I can
It's so important to get the name of the father off because then I won't have to beg him every single time I want to travel with my baby. That's why it's so important... Freedom man!
You have to summon the family court and take a DNA test which is expensive, they range from 500.00 dollars and up, once that is said and done you will be summoned by family court to proceed with the hearings for a favorable or unfavorable decision.
Yes though you have to pay for a paternity test and summon Family court for a hearing.
What should I'm going to do to take off my baby's father name to her b /c?is it possible to do that without layer?
