This will be totally up to the judge to find out for sure, if you can prove that this won't be a detriment to him, then the judge will go in your favor. But if he can prove that it would be, then he would lean towards lowering it. Hope this helps.

Don't know state you are in but in most states yes it can be modified because of pay scale since they use that to determine the amount to be paid.

Yes it can be Modified. But he will have to go through court to do it. It dosnt matter if he is interactive with your child or not. If he is currently paying support and has had his income reduced in ANY way, the support amount will be reduced as well. The law doesn't only protect the children, it also protects the payee as well. They are not going to let him live on the streets and continue to pay you full support. Basically...if he loses income...so do you. Just as if you were still married.

Of course it has to be done via the court, no one is encouraging anyone to take the law into their own hands......

That is funny, my unemployment is only 22% of my pay. It is not even enough to cover my child support. Alone I still have to magically find money for my mortgage, utilities, car payment, etc.
Of coarse child support should be reduced. Further, most states provide for non custodial parents to file modification without costly attorneys. (called pro se)

I thought child support was based on income and at least in CA unemployment is 80% of pay so yeah...it can depending on state.  Too bad the courts don't take into consideration time vs. Money to raise a child or most fathers paying child support would be living in boxes...  That sure would dampen their dating life hunh? Lol

Not funny, most fathers are forced out of their childrens lives by a bias family court system.. A system which forces the father to pay the majority of the childs living expenses. I for one can not spend much time with my child becaused I have been forced into slavery by the courts. My time is spent working to pay 80% of my child's expenses. If my ex would get of her "entitled" ass, get a job, and cover some expenses, I would be able to spend more time with my child.
