If You Are Indicted ,does This Mean You Will Get Prison Time?

If you are indicted, it does not necessarily mean you will go to prison but it generally means that there will be a trial. An indictment means to formally accuse someone of a crime and that person should be put on trial for the crime.

After an indictment has been handed down, you and your lawyer are notified and a court date is usually set. If a person is already in prison and cannot pay the bail money, they will usually remain in prison until the sentence has been set. Bail may not be automatically granted. When deciding whether or not to allow a person bail, the judge will consider various criteria such as the person's past record, past failure to appear, residential history, work history, connections to the community and the severity of the offence.

A release on personal recognizance may require a person to hand over his passport and agree to sign a waiver of extradition if he were to leave the state or country.       

A person is not necessarily guilty of committing a crime just because they have been indicted for it. The indictment does suggest that there is a reasonable amount of solid evidence to suggest a person’s guilt but the person is always considered innocent until proven guilty in a formal court with witnesses and when different sides of a story have been formally heard.
