As long as both parties reach an agreement and that agreement is signed, yes, the final signed document is binding. However, the mediation itself isn't legally binding.

That's because employment mediation is just a structured negotiation where you and the other party try to reach a mutual agreement with the help of a mediator. During these discussions, nothing is set in stone. You can speak freely without worrying that your words will have legal consequences right away.

However, once you reach an agreement and both parties sign it, that agreement becomes legally binding. This means that the terms you've set out in writing must be followed, just like any other contract. Signing the agreement transforms the tentative decisions made during mediation into formal commitments.

It's crucial for both parties to carefully review the terms before signing to ensure that their concerns are fully addressed. After all, the mediation discussions remain confidential. What's put in black and white is what ultimately counts in the end. That's what you can enforce, and what you'll need to follow.
