What are the legalities of monitoring a website? Would the owners be responsible for any abuse?

Owners of a website are responsible for any detail containing inside their web.

Pretty much everything is illegal somewhere.

Even this site sails pretty close to the wind sometimes by allowing medical advice to be given by non-professionals.

The owners (more or less) cover themselves in the T&Cs, (Item 2.4 on this site) but "duty of care" legislation in some European countries means that that may not actually be enough.

(And saying "We can't be held responsible" is not the same as actually not being responsible.)

I've never heard of a website proprietor being sued for such (potential) illegalities though. Who would "do the sueing", and in what country?
