I ran an insurance agency for 6 years and in my experience we never had anyone that was hit from behind at fault. That being said, if you were to say slam on your brakes and make them hit you I'm pretty sure it would still be your fault. As long as you didn't pull out in front of them or slam on your brakes it will more than likely be ruled the other driver's fault.
If you were to back up and hit the car that was behind you, it's your fault.
I was hit at peek hour traffic, the car in front of me braked suddenly n I managed ta brake as for the car in my rear..just hit me causeing the whole back to cave in the are saying they are not at fault due to my car being unwarranted??
My therory has always been if hit in the rear and the accident was nothing ta do with the status of vechiles condition I am not at fault???please help
