If someone is on probation can their probation officer get tex messages that have ben erassed if they suspect ilegal actititivy?

If the probation officer feels they have sufficient reason to believe there has been some sort of illegal activity, and there may be evidence in the text message history of the offender under his authority, he can appeal to a judge and have the text logs obtained from the cell phone provider... Just because you delete it off your phone does NOT mean there is no evidence.
