Yes!!!! They should have the right!!! When it comes to love..through thick or thin that person is always there and their heart doesnt change!

Immigration law ALLOWS marriage to illegal aliens in detention, which overrides the law of the state he is being held.  You have to make sure that the correctional facility he is being held in has a contract with Immigration as an Intergovernmental facility. I know this is possible because my boyfriend's lawyer already filed the application for the marriage, and we are waiting to hear.

The immigration can deal with the asylum seekers case why they are in the country ? And if they are in danger too go back then its a possibility they can stay here until there case is dealt with and keep them going to try for passports will get refused for a while until they know they havent been in trouble with the police

I'm sorry but up to this point you can't. Let him go back to his country and then marry him.

Any marriage in jail has to be with the permission of the governor of the jail. It is highly unlikely that he would permit the marriage of an illegal prisoner. It sounds as though the prisoner will eventually be deported and will not be allowed back in the country. Seems you will have to wait until he is deported and if you still wish to marry him go to his country and live. Your marriage will not make him legal in the eyes of the immigration authorities and he would have to go personally to a US Embassy for an interview for any visa should he wish to return to the US in the future. Having been in jail I do not think he stands a cat's chance in hell of getting back to the US.
