There are certain criteria that categorize the second degree sexual offence and the articles that categorize them are given below: a) A person can be guilty of a second degree sexual offence if he engages in sex with another person either by force or by any means that is not the will of the person. b) The sexual act can also come under second degree when the person is mentally disabled or physically helpless and the person who is involved in the act has knowledge about his condition.

The person who commits the sexual offence can be defined to be in this section in the crime of Class C.
