My brother took out a loan for 5000 dollars and didn't pay it back so they took him to court but the judge told him that if he didn't pay it back all they can do is put it on his credit which would give him bad credit so need less to say he didn't pay it back but the funny part about it is about 6 months down the line they called and gave him another loan you may think i'm lieing but this is the GOD honest TRUTH...I'm still trying to figure this one out myself..
Yes they can,file in small claims court depending on the amount of the loan,or in criminal court,they can also report you as a bad creditor,good luck to you...
