Yes. But sometimes you can have the SSD payment the child receives either replace or offset the monthly obligation. Often SSD is more than your obligation amount. Just file a motion with the court, it's easy and simple to get a judge to sign an order to offset your support obligation.

To the "guest" Yes you will get both payments... As My husband is in the same boat with His ex-wife.  He was ordered to pay $640 a month when first divorced but she gets $1153 due to the fact the Ex-wife ran out and requested a review of the child support when he was deployed to fight for our country..so she got awarded $937 a month plus back pay giving her a grand total of $1153 a month.... But what no one counted on was the fact that he would get hurt and medically retired from the Army... So in April 2009 he was awarded SSD.  And so was she for the kids... $580 a month to be exact... So since april of 2009 she has been getting ruffly $1700 a month child support/SSD.   Well guess what!! She  has been over paid $4, 800 by my husband.   And guess who has to pay it back!! Thats right... She Does!!!So trust me if you know you are "double dipping" I would save it.  IF you ex husband fights for the Childrens SSD to be credited toward the child support you may end up owing the money you have been over paid ... No if you get SSI and Not SSDI not court can take SSI from you by Federal Law therefore what you get from SSI She can not touch If you get SSDI then she can receive part of it not all of it If your children are still are under age and you have there social security numbers they can draw off your SSDI

I believe you have answered your own question my friend.  you are correct up to the words, "or is that a separate"!  I truly do feel for you & pardon the cliche but, "what goes around...." I think you've heard it before.

So let me get the straight until he goes to court to change the papers I get my child support plus the child gets an ss ck?

Can my ex husband receive half my back pay? Plus I got physical custody of our daughter. If I get dependant care can I get child support too?

My ex-wife has been received ssd of 650 a month instead of child support.  I owed back child support. My original was 400.  The child support office said the other 250 cannot be used to pay back child support.  Is this right
